Man With a Van Greenwich Service Terms and Conditions
These Terms and Conditions set out the basis on which Man With a Van Greenwich provides man and van, removals, transport and related services. By making a booking, using our services, or allowing our team to carry out any work, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 "Company" means Man With a Van Greenwich, the provider of removal and transport services.
1.2 "Customer" means the individual, business, or organisation that requests or receives services from the Company.
1.3 "Services" means any man and van, removal, delivery, collection, loading, unloading, packing, or related services provided by the Company.
1.4 "Goods" means any items, belongings, furniture, equipment, or materials handled, transported, or stored by the Company in the course of providing the Services.
1.5 "Service Area" means the primary locations in which the Company operates and offers removal and man and van services, including Greenwich and surrounding areas.
2. Booking Process
2.1 All bookings for Services must be made directly with the Company. A booking is only valid once the Company has confirmed the details, either verbally or in writing.
2.2 At the time of booking, the Customer must provide accurate and complete information, including:
a) Collection and delivery addresses and details of access at each location.
b) The nature, approximate volume, and approximate weight of the Goods.
c) Any special handling requirements or items that require disassembly, reassembly, or particular care.
d) Any restrictions such as parking limitations, time restrictions, stair access, lifts, or long carry distances.
2.3 Quotations are based on the information provided by the Customer at the time of booking. If the information is inaccurate or incomplete, the Company reserves the right to adjust the quotation or charge additional fees on the day of service.
2.4 Bookings are offered subject to availability. The Company reserves the right to decline or cancel a booking where resources are not available or where it considers the job unsuitable or unsafe.
3. Quotations and Pricing
3.1 Unless otherwise specified, quotations are provided on an hourly rate or fixed price basis, as agreed with the Customer at the time of booking.
3.2 Quotations do not include congestion charges, tolls, parking charges, fines, or additional charges incurred due to restrictions at the addresses provided. Such costs will be payable by the Customer in addition to the quoted amount.
3.3 The Company may apply additional charges in the following circumstances:
a) Delays caused by the Customer, their representatives, or third parties, including waiting time at collection or delivery addresses.
b) Additional items or services requested that were not included in the original quotation.
c) Work carried out outside normal operating hours, where this has not been agreed in advance.
d) Extra labour required due to difficult access, heavy items, or inadequate packing.
3.4 All prices are expressed in pounds sterling and are exclusive of any charges that may be imposed by local authorities or third parties in the service area.
4. Payments
4.1 Unless otherwise agreed in advance, payment is due immediately upon completion of the Services on the day of the move or transport.
4.2 The Company may require a deposit or full prepayment to secure a booking, especially for larger removals or longer distance work. Any required deposit will be communicated at the time of booking.
4.3 Payment methods accepted will be communicated by the Company. It is the Customer's responsibility to ensure that funds are available and that payment can be made in full at the agreed time.
4.4 Where payment terms are agreed for business or repeat Customers, invoices must be paid within the period specified on the invoice. Late payments may incur interest and administration charges.
4.5 The Company reserves the right to withhold delivery of Goods or suspend Services if payment is not made in accordance with these Terms and Conditions.
5. Cancellations and Amendments
5.1 If the Customer needs to cancel or amend a booking, they must notify the Company as soon as reasonably practicable.
5.2 The Company may apply cancellation charges as follows, unless otherwise agreed:
a) Cancellation more than 48 hours before the agreed start time: no cancellation fee, and any deposit may be refunded or transferred at the Company's discretion.
b) Cancellation between 24 and 48 hours before the agreed start time: the Company may retain part or all of any deposit.
c) Cancellation less than 24 hours before the agreed start time or on the day of service: the full quoted amount or a minimum charge may be payable.
5.3 If the Customer is not present or not ready at the agreed time and place, the Company may treat this as a cancellation and apply the relevant cancellation charge, or charge waiting time at the applicable rate.
5.4 The Company reserves the right to cancel or postpone a booking due to circumstances beyond its control, including but not limited to severe weather, road closures, vehicle breakdown, staff illness, safety concerns, or legal restrictions. In such cases, the Company will seek to rearrange the booking at a mutually convenient time. The Company shall not be liable for any consequential loss arising from such cancellation or postponement.
6. Customer Responsibilities
6.1 The Customer is responsible for:
a) Ensuring that all Goods are properly packed, secured, and ready for transport, unless packing services have been specifically included.
b) Labeling boxes clearly where necessary, especially where fragile or delicate items are involved.
c) Ensuring that all appliances are disconnected, defrosted, and drained, and that all fixtures and fittings are properly removed and made safe.
d) Arranging suitable parking and any permits required for the Company's vehicles at both collection and delivery addresses.
e) Informing the Company of any access issues, such as low bridges, width restrictions, narrow roads, or height limits affecting the vehicle route.
6.2 The Customer must not ask the Company to transport any items that are illegal, dangerous, explosive, flammable, corrosive, perishable to an unreasonable extent, or otherwise unsuitable for carriage.
6.3 The Customer must inspect the vehicle at the end of the job to ensure that nothing has been left behind.
7. Company Responsibilities
7.1 The Company will use reasonable care and skill in providing the Services and will take reasonable steps to protect the Customer's Goods while they are in its care.
7.2 The Company will provide a suitable vehicle and, where agreed, sufficient labour to carry out the removal or transport.
7.3 The Company will endeavour to arrive at the agreed time, but timings are estimates only. The Company shall not be liable for delays caused by traffic, weather, road conditions, or events beyond its reasonable control.
8. Exclusions and Limitations of Liability
8.1 The Company shall not be liable for any loss, damage, or delay arising from:
a) The Customer's failure to pack Goods properly, unless the Company has agreed to provide packing services.
b) Inherent defects or vulnerabilities in the Goods, including but not limited to fragile, self-assembled, or flat-pack furniture, or items which are already damaged or in poor condition.
c) Normal wear and tear, minor scuffs, or scratches that occur in the ordinary course of moving.
d) Acts or omissions of the Customer or any third party.
e) Circumstances beyond the Company's reasonable control.
8.2 The Company will not be liable for:
a) Loss of profits, loss of business, loss of data, loss of goodwill, or any indirect or consequential loss.
b) Damage to property, including building interiors, where access is restricted or where items are moved at the Customer's insistence despite the Company's advice.
8.3 The Company's total liability in respect of any claim for loss or damage, whether arising in contract, tort, or otherwise, shall be limited to a reasonable amount having regard to the value of the Goods and the fees paid for the Services. The Company may at its discretion offer repair, replacement, or a financial contribution towards repair.
8.4 The Customer must notify the Company in writing of any loss or damage as soon as reasonably practicable and in any event within 48 hours of completion of the Services. Failure to do so may prejudice any claim.
9. Items Excluded from Liability
9.1 The Company shall not be liable for loss of or damage to the following items, unless specifically agreed in advance:
a) Jewellery, watches, precious metals, stones, or similar valuables.
b) Money, credit cards, securities, or financial documents.
c) Important documents, passports, deeds, or licences.
d) Plants, animals, or perishable goods.
e) Items of sentimental value where the true value cannot be assessed.
9.2 The Customer is advised not to include such items with the Goods to be moved and to keep them in their personal possession at all times.
10. Waste and Rubbish Regulations
10.1 The Company is a removal and transport service and is not a licensed waste carrier unless expressly stated. The Company will not remove or dispose of household, commercial, or construction waste unless this has been agreed in advance and complies with applicable waste regulations.
10.2 The Customer must not present items for removal that constitute controlled waste, hazardous waste, or prohibited materials. This includes but is not limited to:
a) Chemicals, solvents, paints, oils, or fuel.
b) Asbestos, clinical waste, or materials containing harmful substances.
c) Gas bottles, cylinders, or pressurised containers.
d) Tyres, certain electrical items, or other items restricted by law.
10.3 Where the Company agrees to remove items for disposal, the Customer confirms that they are entitled to dispose of those items and that they do not breach any waste, environmental, or recycling regulations.
10.4 The Customer is responsible for any fines, penalties, or costs incurred by the Company as a result of being asked to remove or transport unlawful or improperly described waste or materials.
11. Access, Parking, and Service Area
11.1 The Customer must ensure that there is suitable and legal parking for the Company's vehicles at both collection and delivery addresses. Any parking fees or fines incurred due to inadequate arrangements will be payable by the Customer.
11.2 The Company operates primarily within its designated service area, including Greenwich and nearby locations, but may agree to travel outside this area by prior arrangement. Additional mileage or travel time may be charged accordingly.
11.3 If access to premises is restricted or unsafe, the Company may refuse to proceed or may require the Customer to sign a disclaimer before attempting to move certain items.
12. Delays and Waiting Time
12.1 If the Company or its staff are required to wait at any location due to delays beyond its control, including delays in obtaining keys, paperwork, or access, waiting time may be charged at the applicable hourly rate.
12.2 The Company shall not be responsible for any losses incurred by the Customer due to delays arising from traffic, accidents, weather, or other causes beyond the Company's reasonable control.
13. Insurance
13.1 The Company maintains appropriate insurance cover for its vehicles and business operations, as required by law.
13.2 The Customer is strongly advised to arrange their own insurance for high-value items and for the overall move, especially where the value of the Goods exceeds any limitation of liability under these Terms and Conditions.
14. Complaints
14.1 If the Customer has any concerns or complaints about the Services provided, they must raise them with the Company as soon as possible, ideally on the day of service.
14.2 The Company will investigate any complaint and, where appropriate, seek to resolve the matter amicably through discussion, remedial work, or a goodwill gesture.
15. Data Protection and Privacy
15.1 The Company will collect and use personal data provided by the Customer for the purpose of arranging and carrying out the Services, processing payments, and handling enquiries or complaints.
15.2 The Company will take reasonable steps to keep personal data secure and will not share it with third parties except where necessary to provide the Services or where required by law.
16. Termination
16.1 The Company may terminate or suspend the provision of Services immediately if the Customer:
a) Fails to pay any sum due when required.
b) Behaves in an abusive, threatening, or unsafe manner towards the Company's staff.
c) Requests the Company to undertake illegal or unsafe activities.
16.2 In such cases, the Customer may be liable for any losses, costs, or damages sustained by the Company as a result of the termination.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or the Services provided by the Company, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including any non-contractual disputes or claims.
18. General Provisions
18.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
18.2 These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any prior agreements, understandings, or representations.
18.3 No variation of these Terms and Conditions shall be effective unless agreed in writing by the Company.
18.4 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company.
18.5 The Company reserves the right to update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking.
